, Ofc. A. Kinner [65583] and I, Ofc. B. Wilber [65491] operated as a two-officer unit working off-duty at Club 51 Degrees located at 121 W. Congress St. Both officers were wearing police uniforms with our badges clearly displayed.
Around 2330hrs, officers were flagged down by security guards working at the nearby bar Eclipse at 127 W. Congress St. I saw a hispanic male, later identified as Mr. Quanah Mariano, standing on the sidewalk and attempting to push his way past security guards and into the business.
FELONY OBSTRUCTION
Ofc. Kinner and I grabbed Mr. Mariano by the shoulder from behind and told him that he needs to leave. At this time, Mr. Mariano turned toward officers and took a fighting stance, balling his fist and attempted to punch Ofc. Kinner in the face. Ofc. Kinner was able to move his head and dodge the punch. Ofc. Kinner and I grabbed Mr. Mariano by the arms and pinned his chest against a parked sedan in an attempt to detain him in handcuffs.
Mr. [VICTIM ], a bystander, assisted officers with placing Mr. Mariano in handcuffs. During the handcuffing process, Mr. Mariano was tensing his arms, pulling them to the front of his body, and kicking his legs in the air while he was still pinned against the parked vehicle. Once handcuffed, Mr. Mariano was escorted to my police vehicle which was parked near Sorry Charlie’s Oyster Bar.
Ofc. Kinner was attempting to Mr. Mariano, as he was under arrest for disorderly conduct, criminal trespass and public drunkenness. Mr. Mariano repeatedly turned his body toward Ofc. Kinner despite verbal commands for him to “stop turning” and to “face the car”. I was holding Mr. Mariano’s arms up by the links in his handcuffs and saw that he was trying to slip his wrists out of the cuffs. I tightened the cuffs to prevent him from releasing his hands due to his combative behavior. Mr. Mariano was kicking his feet back toward me attempting to kick my shins during this process.
I made the decision to lay Mr. Mariano on the ground to be able better restrain him and prevent officer injury. I grabbed Mr. Mariano’s legs and Ofc. Kinner grabbed his shoulders and he was escorted to the ground (lightly) onto his stomach. I crossed his feet and pinned them to his lower back to prevent him from kicking further. Mr. Mariano continued to attempt to straighten his legs and twist his body around. Ofc. Jiminez, who was working off-duty at B&D Burgers, arrived on scene to assist Ofc. Kinner and I.
The of Mr. Mariano was completed and I released Mr. Marino’s legs. While attempting to turn Mr. Marino onto his back to sit him up, he began kicking Ofc. Kinner in the legs. He was consequently placed into leg shackles and I stood on the chain to pin his feet to the ground. Mr. Mariano began yelling profanity and racial slurs, such as “sit me up so I can suck your di*k, white-boy.” At one point, he managed to plant one foot onto my ankle and said “I’m about to kick you, you feel that?” I told Mr. Mariano to move his foot but he did not comply. I moved his foot with my hands and used both of my feet to stand on the chain of the leg shackles.
ADDITIONAL NOTES
Mr. Mariano’s pupils were dialated and very large, an effect of certain narcotics. The odor of an alcoholic beverage was emanating from his breath and person during our close encounter.
No military ID was found on Mr. Mariano’s person, but it is likely that he is active duty military. His only identification was a driver’s license out of New Mexico.
CHARGES
Ofc. D. Johnson arrived on scene to transport Mr. Mariano to CCDC. He refused to place his legs into the vehicle and had to be pulled in by his arms from behind. He was booked into CCDC on the charges of:

[O.C.G.A 16-11-39] – Public Drunkenness
[O.C.G.A 16-11-41] – Disorderly Conduct
[O.C.G.A 16-7-21] – Criminal Trespass
STATEMENTS MADE BY COMPLAINANT
Mr. [VICTIM ] approached officers once Mr. Mariano was taken to CCDC by Ofc. Johnson. He stated that Mr. Mariano had bumped into his friend inside of Eclipse. Mr. Mariano then turned and said “I’m 11B, I’m better than you” and punched Mr. [VICTIM ] in the face. The security working at Eclipse saw this exchange and began pushing Mr. Mariano out of the bar. Once outside, they waved Ofc. Kinner and I for assistance.
