I, Corporal J. Eblin, responded to the 3G gas station located at 703 Wheaton Street for a report of less individuals trespassing on the property. Upon arrival on scene I activate my body worn camera and began to investigate. I found Ms. Tiffany Lamasko sitting on the sidewalk directly next to the entrance of the store.
The 3G has several large “NO TRESPASSING” signs as well as a Citizens Agreement for the location due to the frequency of loitering.
One of the employees of the 3G opened the door and advised that Ms. Lamasko was banned from the location permanently.
I detained Ms. Lamasko in handcuffs to the rear and escorted her to my Marked Police Vehicle. Upon arrival at my vehicle Ms. Lamasko advised she wanted to go to the hospital. When I asked what for Ms. Lamasko advised “I haven’t decided yet.”
I found that Ms. Lamasko had been banned from the location since 02/13/2016. I placed Ms. Lamasko under arrest for Criminal Trespass.
A female Officer responded to the scene and ed Ms. Lamasko incident to the arrest. After the Ms. Lamasko was secured in the transport area of my Marked Police vehicle with a seatbelt and transported to CCDC.
While enroute to CCDC Ms. Lamasko abruptly demanded to go to the hospital. When I asked why, Ms. Lamasko advised she wanted a “CT scan”. When I explained that the ER typically needs a reason to order a test, Ms. Lamasko advised she wanted to go to MMC because “it’s my right.”
I diverted to Memorial Medical Center (MMC) for medical clearance. While enroute Ms. Lamasko advised she needed medical clearance due to the following complaints:
“jumped and fell”
“hurt knee”
“previous stroke”
“it’s my right”
Upon arrival at MMC Ms. Lamasko advised much the same to MMC staff. Ms. Lamasko advised the attending physician that she needed “a Pepsi cold” and “a sticker” when the doctor asked Ms. Lamasko to clarify what she wanted Ms. Lamasko advised a “smiley face” sticker.
Ms. Lamasko eventually became upset and then demanded to leave MMC after staff had seen her and advised she needed a Tetanus shot. Ms. Lamasko admitted that she only wanted to come to MMC for a “cold Pepsi” and to attempt and delay the arrest.
Ms. Lamasko then demanded to be released Against Medical Advice (AMA) and to just leave MMC without treatment. Despite me telling staff and staff advising they would discharge Ms. Lamasko, she continued to yell at random people about a “cold Pepsi” and a “sticker”. Once MMC discharged Ms. Lamasko I escorted her back to the transport area of my Marked Police vehicle and continued to CCDC.
Ms. Lamasko was booked into CCDC without incident and charged with Criminal Trespass (O.C.G.A 16-7-21) for trespassing on the 3G property after being banned. Ms. Lamasko was also charged with Disorderly Conduct (O.C.G.A 16-11-39) for her behavior at MMC.
