On 7/15/24 I responded to [5100 BLOCK] Fox Den Rd. regarding a dispute between neighbors. The caller told dispatch that they have had prior incidents with their neighbors at [5100 BLOCK] Fox Den Rd. and that the female owner had previously been issued a criminal trespass notice for the [5100 BLOCK] address. The caller stated that tonight the neighbor threw a bag filled with trash over the fence from the backyard of [5100 BLOCK] into [5100 BLOCK]. Someone then came to their door and began knocking but they did not want to answer.
I arrived on scene and located a female standing in the driveway of [5100 BLOCK] Fox Den Rd. I walked up and asked what was going on, she identified herself as [WITNESS ] and stated her partner (the owner of [5100 BLOCK] Fox Den Rd.) had issues with the neighbors at [5100 BLOCK] Fox Den Rd. and tonight while out in the backyard had thrown a bag filled with trash over their fence into the [5100 BLOCK] yard.
[WITNESS ] then offered to get the owner so I could speak with her. The owner, Sheena Weghorn, came outside and was upset that police were there. She started to blame [WITNESS ] for being outside and that’s why the police were talking with her.
I introduced myself to Weghorn and asked what was going on that caused police to respond. She stated that she had a long history with the neighbors at [5100 BLOCK] Fox Den Rd. and began telling me about it. I then asked what happened tonight, she stated she was in her backyard having a conversation with her partner ([WITNESS ]) and during it she was throwing things around and something flew over the fence into the neighbors yard. She then told me she was going inside and did not want to deal with anything. I informed her she was not free to leave at this time and needed to remain outside. Weghorn became agitated and started talking out how she was black and this was the reasoning behind why the neighbors called, she further stated that I should place her into handcuffs and that I was going to take her to jail. I explained to her there was no reason to place her into handcuffs and that she just needed to stay outside while we investigated what took place. Officer Earle 521 had arrived on scene and went to [5100 BLOCK] to speak with the caller.
While waiting for Officer Earle, Weghorn continued to state that she was having this issue due to her race and that police kill black people and she wanted others to see what was happening. I informed Weghorn that she needed to stop yelling and cursing outside due to other neighbors being disturbed and that I did not want to arrest her for disorderly conduct. She calmed down for a short time. Several times while waiting for Officer Ealre to finish speaking with the caller, Weghorn raised her voice and began yelling and cursing outside, I gave her several warnings that she would be arrested for disorderly conduct if she did not stop.
Officer Earle returned for speaking with the resident of [5100 BLOCK] and had a white plastic trash bag with trash inside. He explained to me that was the bag thrown from the yard of [5100 BLOCK] into [5100 BLOCK], the residents of [5100 BLOCK] had the incident on video. At this point I asked Weghorn for her ID so I could issue her a citation for throwing the trash over the fence into her neighbors yard (City Code 30-2).
While Weghorn got her ID from her car, Officer Earle had spoken with [WITNESS ]. She stated that while in the backyard Weghorn threw the bag of trash over the fence into the yard of [5100 BLOCK].
I returned to my patrol vehicle and issued citation 515002746 for violation of Oakwood City Code 30-2. I returned to Weghorn and attempted to explain the citation. While explaining, Weghorn continued to interrupt me and said she wanted to tell me something. I told Weghorn that she needed to listen to me explaining the citation and once complete I would listen to her. I finished the explanation and began to hand Weghorn the citation to sign, she then snatched her copy from the back of my clipboard and stated she was not signing and was going inside. I told Weghorn that she needed to sign or she would be arrested.
Weghorn continued to try and explaining something to me, I gave her several opportunities to sign the citation and eventually stated this was her last chance or she would be arrested. I then began to count to three, while counting, Weghorn said are you counting to me like I am a child. Once I got to three, I told Weghorn she was under arrest, she began saying she would sign and that she was sorry. I informed her that we were past that and she was now under arrest. Weghorn was placed into handcuffs (checked for fit/double locked) and placed into the rear of my patrol vehicle. Weghorn continued to apologize for her behavior and said she would sign the citation now, I explained that was no longer and option and I did not want to arrest her which is why I was trying to release her on a signed citation.
Weghorn stated she did not want [WITNESS ] to watch her kids who were inside sleeping. Weghorn’s sister was ed by phone and stated she would come over in 30-45 minutes to watch the children. Weghorn agreed to allow [WITNESS ] to watch the children until then.
I transported Weghorn to the Hall County Jail. Once at the jail when I had Weghorn exit the rear of my patrol vehicle, she put both hands in front of her and showed me that she had slipped out of one of her handcuffs. I told her to place her hands behind her back and entered into the Jail inmate area where I placed the handcuff back onto her. Custody was then transferred to the deputies on duty.
The caller provided a copy of the video of the incident which will be attached to this report. The caller was advised on the TPO process.
While driving to the jail, Weghorn stated she was concerned for the safety of the female neighbor at [5100 BLOCK] due to hearing things through the wall. She is concerned that she will end up dead soon if not looked into. She stated she does not call the police so there is no police history. I advised her I would document her concern in this report.
