Discretion is advised.]On 19 February, 2025at approximately 00:22 hours, I exited the Dalton Police Department turning left onto W. Waugh St. proceeding eastbound.As I approached the intersection of W. Waugh St. and Jones St. I was stopped at a red light and I observed a taxi cab, 2016 Toyota Camry, Ga tag [REDACTED], exit the front parking lot of the police department onto Jones St. and turn left onto W. Waugh St. I observed a Pick Up truck, 2013 Ford F-150 Ga tag, [REDACTED] also exit the police department right behind the taxi cab. Both vehicles were proceeding eastbound at this time on W. Waugh St.I observed the taxi cab to stop in the center turn lane on W. Waugh St and activate its hazard lights on directly beside the First Baptist Church. I observed the Ford Pick Up truck to accelerate quickly past the taxi cab as I heard the engine rev highly and loud exhaust. This manner of driving behavior caught my attention and I proceeded to follow the truck to observe its driving behavior further. The truck made a right turn onto N. Selvidge St. I then turned onto N. Pentz st. and proceeded to W. King St. and back to N. Selvidge. St. I did not see the truck at this time.As I approached the red light at N. Selvidge St. and W. Waugh St. I observed the truck again accelerating northbound on N. Thornton Ave. At this time. I decided to investigate the suspicious driving behavior of the truck further. As I was proceeding northbound on N. Thornton Ave. I was at the intersection of N. Thornton Ave. and W. Tyler St. I observed the same taxi cab from earlier traveling southbound on N. Thornton Ave. at a high rate of speed with the truck behind it also traveling at a high rate of speed. The taxi cab was blowing its horn in an attempt to get my attention. Based on my observations, I suspected the truck was chasing the taxi cab and turned my patrol car around and initiated a traffic stop on the vehicle. Both the taxi and truck stopped at N. Thornton Ave. and W. Tyler St. facing southbound.Once there, I requested additional units and stood-by waiting for other officers to arrive. Ofc. Thornton arrived on scene. Unaware of the situation between the two vehicles, I drew my department issued pistol and held it at a low ready where I gave the driver of the truck, Luis De La Torre Cabrera, verbal commands to stick his arms out of the window. Luis complied and I had him exit the vehicle and walk back towards me. Luis was placed on his knees where he was detained in handcuffs by Ofc. Thornton at this time pending further investigation.While detained, Luis was highly agitated, moving his body in an unnatural jerking manner, unfocused and sweating heavily. Luis would continually try to stand up and appeared to be very agitated. I suspected Luis to be under the influence of methamphetamines and ask him if he had smoked meth to which he stated he had. Luis was stating “she was being kidnapped”, the subject he was referring to was his girlfriend, [VICTIM ], who was a passenger inside the taxi cab. I patted Luis for weapons and did not locate any. I placed him in the rear of my patrol car until I could investigate the incident further.Ofc. Sosa and Thornton spoke to the taxi cab driver, [VICTIM ], who advised that he picked [VICTIM ] up this date from McDonalds on the Cleveland Highway and she requested to go to the crisis center to get away from Luis. [VICTIM ] stated he drove her there but she was not accepted. [VICTIM ] then drove her to the Dalton Police Department but advised the front doors were locked and did not know to use the call box. [VICTIM ] stated while at the police department, Luis arrived in his truck and began following them aggressively. [VICTIM ] stated once he left the police department, he observed me driving by and stopped activating his hazard lights to get my attention. [VICTIM ] stated once I drove past, he proceeded towards the Whitfield County Sheriff’s Office for further assistance for [VICTIM ] when Luis began following them again but this time in a more aggressive manner.[VICTIM ] stated as they were traveling northbound on N. Thornton Ave. near the Salvation Army located at 1109 N. Thornton Ave, Luis passed their vehicle at a high rate of speed and aggressive manner, crossed a solid double yellow line and striking the front driver side quarter panel of the taxi cab. [VICTIM ] stated he was in fear Luis was attempting to harm him by ramming his vehicle and turned the taxi around and proceeded southbound to get away from Luis. [VICTIM ] stated Luis also turned his vehicle around in an aggressive manner and began driving towards them at a high rate of speed. [VICTIM ] stated as he was traveling southbound he spotted my patrol car and began blowing his horn. [VICTIM ] then stopped at the red light on N. Thornton Ave. and W. Tyler St. where I conducted a traffic stop on the vehicles. I observed fresh scrapes to the area described by [VICTIM ] along with fresh marking on the front driver side tire consistent with a vehicle colliding with the taxi cab.I spoke with the taxi cab owner, [VICTIM ] via telephone about the incident. [VICTIM ] advised he wished to pursue charges in the matter of criminal trespass damage to property due to his vehicle being damaged by Luis during this incident. [VICTIM ] was provided a case card.[VICTIM ] was in the back seat of the vehicle and was visibly upset, crying, shaking and scared. [VICTIM ] stated she and Luis are dating and living together and went to McDonalds this date. While there they got into an argument. [VICTIM ] stated Luis has been physically abusive towards her recently but had not reported the incidents but wanted to get away from him. [VICTIM ] stated she then called a taxi to come get her and go the crisis center for help. [VICTIM ] stated after she left in the taxi, Luis then began following the taxi as he knew she was in it. [VICTIM ] stated she was in fear that Luis was going to use his vehicle to cause her harm and feared Luis would harm her further. [VICTIM ] requested EMS to look at her as she disclosed an injury to her head from an altercation involving Luis from two days ago. EMS arrived and evaluated her to which she refused to go to the hospital.I then spoke to Luis again where I advised him of his miranda warning. Luis agreed to speak to me. Post miranda, Luis stated he and [VICTIM ] were at McDonalds earlier and that they had argued. Luis stated [VICTIM ] got out of the truck and into a taxi but he had heard her say “don’t kill him”. Luis appeared to be paranoid which is a common symptom of methamphetamine use as he was talking non-sensical about people following them.Luis continued by stating the once [VICTIM ] left, she “went dark” and he did not know where she was. Luis stated he received a text message from her stating she was going to the police. Luis stated he proceeded to the Dalton Police Department where he saw her in the taxi cab. Luis stated he thought [VICTIM ] was in danger and that she was being kidnapped. Luis stated the taxi then “sped off” and he followed concerned for [VICTIM ]’s safety. Luis stated the taxi made a sudden turn onto N. Thornton Ave. and he followed. The last statement was not true as I observed the two vehicles in the area and the sequence of events stated earlier.I ask about passing the taxi and Luis stated he passed the taxi and got in front of it in an attempt to stop the vehicle. Luis denied the two vehicles colliding. I then ask Luis the last time he consumed meth and he advised around 09:00 (02/18/2025).Mpo dykes relocated to the area of the Salvation Army and advised me he located fresh tire marks in the grassy area. Luis stated he turned around in the area and the observed disturbance in the grass would indicate that Luis aggressively turned his vehicle around as if he was chasing the taxi cab.Based on my observations, witness statements, and Luis’ statements I advised him he was under arrested. Luis did utilize his vehicle in an offensive manner which was likely to cause serious bodily injury to [VICTIM ] and [VICTIM ]. During this altercation, Luis did operate his vehicle in a reckless and aggressive manner that caused damage to the taxi cab all the while possibly being under the influence of a narcotic. Luis also committed the offense of stalking [VICTIM ] by knowingly following her in the taxi cab while intimidating her. Due to Luis’ behaviors earlier, he was not removed from my vehicle. I transported Luis to the Whitfield County Jail where upon arrival, I secured my service pistol on the lock boxes provided. Luis advised he is a US citizen.Bobs towing was ed and arrived on scene shortly after. Luis’ vehicle was towed from the scene.[VICTIM ] and [VICTIM ] left the scene. Luis was turned over to the booking staff where a of his person was conducted. A blue zip top bag containing a white crystalline substance (suspected meth) was located in his front right pants pocket. A presumptive field test later yielded positive results for meth. While at the jail, I read Luis implied consent and requested a blood draw for suspected dui drugs due to him operating a motor vehicle while exhibiting signs of being under the influence of a narcotic coupled with his admission to consuming meth earlier. Luis consented to the blood draw and Sgt. Brewer with the Whitfield County Sheriff’s Office completed the test. Once signed and sealed the blood test kit was turned over to me. I then issued Luis citation 90244 for aggressive driving, citation 90245 reckless driving, and citation 90246 for dui less safe drug. These citations were attached to the warrantless arrest form 0023 which included the following charges:Violation of O. C. G. A. 16-5-21 – Aggravated assaultViolation of O. C. G.
