On September 21st, 2024
at 2047 hours I was dispatched to [20 BLOCK] Glenmore Dr, Kingston, GA 30145 in reference to a domestic dispute.
Upon arrival I observed Officer McDonald 05 at the front door with the suspect, Dakotah Pirkle at taser point. Officer McDonald advised when he arrived on scene, he heard what seemed to be a physical altercation taking place inside the residence. Officer McDonald stated when he opened the front door to go deescalate the situation Dakotah came towards him in an aggressive manner, causing him to pull his taser out. Officer McDonald secured his taser once I got to the door to assist. Officer McDonald advised me that he had prior knowledge of a order of bond that had conditions that Dakotah was not allowed to consume alcohol from a previous case he had be involved in.
I spoke with Dakotah whom stated he was in an argument with his mother, [VICTIM ] about his soon to be ex wife, [WITNESS ]. Dakotah stated [VICTIM ] started to argue with [WITNESS ] when she arrived to pick up their children, [REDACTED BY AGENCY] and [REDACTED BY AGENCY]. Dakotah stated he was trying to calm [VICTIM ] down, which caused him and [VICTIM ] to start arguing. Dakotah stated he helped his step father, [WITNESS ] put [VICTIM ] in the truck so [WITNESS ] could take her . Dakotah stated he was drinking an alcoholic beverage during the party with [VICTIM ], he also stated things escalated due to them being intoxicated. Dakotah stated nothing got physical during the arguments.
I asked dispatch to confirm Dakotah’s order of bond, which they did verify through warrants and records. Dispatch stated Dakotah’s order of bond stated he couldn’t cause any further disturbances requiring Law Enforcement presence and shall not consume or possess any alcoholic beverages. I observed several factors that lead me to believe Dakotah was intoxicated. I observed Dakotah’s up and down mood swings, blood shot and watery eyes, slurring of his words, his repetitive statements, and Dakotah stated he was upstairs watching football and drinking beer.
I attempted to get statements from [REDACTED BY AGENCY] and [REDACTED BY AGENCY] but both were uncooperative and hostile towards law enforcement, due to them not wanting Dakotah to go to jail.
I spoke with the neighbor, [WITNESS ] whom stated he called 911 when a lady came to his house and asked him to call 911. [WITNESS ] stated he observed two juveniles holding back a male from possibly hitting [VICTIM ] during the argument.
I determined based on all statements provided that Dakotah charged at [VICTIM ] during the argument causing her to be in reasonable fear of receiving a bodily injury. Dakotah used profane and vulgar language towards [VICTIM ], that a reasonable person would believe are fighting words used to provoke violent resentment. Based on statements of all parties involved Dakotah was charged with disorderly conduct and violation family violence order.
Dakotah was placed under arrest and handcuffed to the rear. Dakotah was placed in the rear of my patrol vehicle. Dakotah was transported to the Bartow County Jail and during the transport made the utterance that he had consumed alcohol which was a violation of his bond order. Dakotah was turned over to the jail staff without further incident.
I relocated to [70 BLOCK] Sherwood Ln, Cartersville, GA 30120 in attempt to speak with [VICTIM ] and [WITNESS ] about the incident that took place at Dakotah’s residence. I spoke with [VICTIM ] whom stated she was over at Dakotah’s for the birthday party, when [WITNESS ] showed up to pick up [REDACTED BY AGENCY] and [REDACTED BY AGENCY] [VICTIM ] stated she got upset and started arguing with [WITNESS ] when she started to laugh at Dakotah. [VICTIM ] stated Dakotah intervened to calm her down and that is when her and Dakotah got in their argument. [VICTIM ] stated whatever took place was family business and she wasn’t going to discuss it.
I spoke with [WITNESS ] whom stated he was out of town during the party. [WITNESS ] stated [VICTIM ] called him to come pick her up. [WITNESS ] stated once he arrived to Dakotah’s house, Dakotah and [VICTIM ] were arguing about [WITNESS ], he told [VICTIM ] to get in his truck and both of them left.
Warrants for the violation of Dakotah’s order of bond and Disorderly Conduct have been secured.
