On August 23, 2024
at 2300 hours, I was traveling west on Victory Drive near the Harry Truman Parkway Overpass when I observed a black Mercedes Benz traveling in front of me. The vehicle merged into the left turn lane to merge south onto Harry Truman Parkway, when the driver made a last minute decision to make a lane change back into the west bound lanes of Victory Drive without signaling. As I was traveling behind the vehicle on Victory Drive, the vehicle failed to maintain it’s lane of travel several times by drifting into the right lane, then back into the left lane. I approached the rear of the vehicle and initiated a traffic stop by activating my patrol vehicles blue lights. The vehicle came to a complete stop on the right shoulder of Victory Drive near the intersection of Ash Street.
I approached the driver side window and could immediately smell the odor of an alcoholic beverage emitting from inside of the vehicle. I asked the driver, Anne Pappas, where she was coming from tonight and she stated she was playing tennis earlier in the evening. I asked her what time she finished playing tennis and she stated it was about three hours ago. Due to the odor of an alcoholic beverage emitting from inside of her vehicle, I asked Mrs. Pappas how mush alcohol she had consumed tonight and she stated she had a glass of wine this evening. I instructed Mrs. Pappas to exit the vehicle and stand at the front of my patrol vehicle while continued with my investigation.
While standing at the front of my patrol vehicle, I could smell the odor of an alcoholic beverage emitting from her breath, she was slurring her words, and she had bloodshot watery eyes. I asked Mrs. Pappas if she would be OK if I checked her eyes to make sure she was safe to drive and she agreed.
After medically clearing Mrs. Pappas, I observed 6 out of 6 clues during the Horizontal Gaze Nystagmus Test. The Walk and Turn and One Leg Stand Test were not performed due to the Mrs. Pappas stating she injured her Achilles while playing tennis. I returned to my patrol vehicle to retrieve my Alco-Sensor FST and asked Mrs. Pappas if she would be willing to provide a preliminary breath sample and she refused. Mrs. Pappas was placed into handcuffs and was notified that she was being charged with DUI. I placed her in the back seat of my patrol vehicle where I read Mrs. Pappas her Georgia Implied Consent Notice for ages 21 or over and she refused.
Mrs. Pappas was transported to the Chatham County Jail where she was released to the Deputies.
