Discretion is advised.][NARRATIVE on February 14, 2025]On 02/14/2025at approximately 0250 hours, I was patrolling the downtown area when I observed a Hispanic male urinating on the sidewalk in the view of potential vehicle traffic near Milly Grub, 101 South Wayne Street.When I got out with the male, he attempted to walk off until I told him to stop. Once the male stopped, I asked for his identification and noticed he was highly intoxicated to the point he had difficulty standing. Noticing that the male did not speak English, I called for Sgt. Chambers to respond to my location. While waiting for Sgt. Chambers to arrive, the male, later identified as Marcos Santiz, opened his bookbag in an attempt to get his identification. While leaning over looking for his identification, Santiz started leaning up where he lost his balance and started to fall. I attempted to catch Santiz but could not stop his body weight from falling.While Santiz was on the ground, he handed me his Mexico identification card. I then placed a handcuff on Santiz’s right wrist when he began say “no no.” While trying to secure Santiz’s left wrist behind his back, he leaned back on me. It was at this time Sgt. Chambers arrived on scene. While still trying to place the cuff on Santiz’s left wrist, he began tensing up while his hands were behind his back. I then told Santiz to stop when he said “okay.” Santiz continued to tense his arms until I secured his left wrist in the cuff. Santiz was then secured in double locking handcuffs per departmental policy.Sgt. Chambers and I then lifted Santiz to his feet and walked him to Sgt. Chambers patrol car. Once Sgt. Chambers unlocked his vehicle, I opened the door and told Santiz to get in. It is believed Santiz knew what I was saying when I told him to get in because he responded “no.” I then began leaning Santiz into the patrol car when he tried to kick me with his right foot, coming close to my right knee. I then pushed Santiz into the patrol car by pushing on his upper chest with my right hand and told him “you are not going to kick me.” When I removed my hand from his chest, Sgt. Chambers began telling Santiz in Spanish to “get up please.” Santiz was given numerous verbal commands to get in the car but he refused.In an attempt to have to use less force on Santiz to get him in the patrol car, I called for an additional unit to help get Santiz into the patrol car. When Officer Childress arrived on scene, he assisted me by picking up on Santiz’s feet while I pushed him into the patrol car.Once Santiz was in the patrol car, he was secured in a seat belt, per departmental policy. Santiz was then transported to the Baldwin County Jail where he was turned over to personnel for processing.Santiz was charged with public indecency, public drunkenness, and obstruction.A Use of Force Report was completed.[End of Narrative][NARRATIVE on February 14, 2025]On 02/14/2025at approximately 0254 hours, I responded to the 100 block of South Wayne Street, in reference to assisting Lieutenant Ryan Chapple with a suspicious person.Upon my arrival, I observed an intoxicated Hispanic male sitting on the ground with Lt. Chapple attempting to place him in handcuffs. I recognized the male as Marcos Santiz. I assisted Lt. Chapple by holding Santiz’s left arm in place so he could secure Santiz in handcuffs. After securing the handcuffs, Santiz began to slump over due to his inebriation so I placed my leg against his back to keep him propped up.With Lt. Chapple’s assistance, we lifted Santiz to his feet and began assisting him towards my patrol car. Santiz could barely walk on his own and began to verbally express frustration in Spanish. When attempting to place him in the rear of my patrol car, Santiz stated “No” several times when told to get in the seat. Lt. Chapple attempted to lift Santiz into the seat, but Santiz kicked his foot out attempting to strike Lt. Chapple. Lt. Chapple ordered Santiz not to kick and continue to try and assist him into the car. I gave several verbal commands in Spanish to attempt to coax Santiz into the vehicle but was unsuccessful. I attempted to assist Lt. Chapple by lifting up Santiz’s right leg, but due to the tight spacing in the doorway, I was unable to lift properly. While I was attempting to talk Santiz into complying, Lt. Chapple called for additional units to assist. Officer John Childress arrived and was able to assist Lt. Chapple in placing Santiz into the vehicle.Once Santiz was properly secured in my patrol car, he was transported to the Baldwin County Law Enforcement Center. Upon arrival, I advised Santiz to step out of my vehicle, but he refused. I once again attempted to gain compliance through commands in Spanish, but he refused. At this point, I grabbed Santiz’s right arm and assisted him out of the vehicle. Lt. Chapple and I walked Santiz into the booking area of the jail where he was turned over to jail staff.[End of Narrative].
