Discretion is advised.]On Sunday, February 9th, 2025at approximately 00:30 hrs, I responded to [1000 BLOCK] Shawnee Street [REDACTED] for a domestic incident.The caller was noted as the child of the mother and father involved in the domestic incident. The call notes were advising the child was text messaging the dispatcher and updating them with details on what was occurring. The “texter” advised his father “Jonathan Franklin” was threatening to kill his mother [VICTIM ]. The texter advised that they were now hiding and the father was threatening to kill the mother. The texter advised the father is choking mother. The texter advised the father is “using his hands to killer her”.Officer Kareem and I arrived to the scene quickly based off of the exigency displayed in the call notes. Once there, I observed a black male peek over the balcony in front of #[REDACTED]. I could hear him raise his voice and banging on the door of the residence. I quickly approached and announced for him to come down the stairs and show me his hands. He complied and started to walk down the stairs. I met him half way down the steps and noticed his right hand had blood on it. It appeared to be coming from one of his fingers.I glanced up at #[REDACTED] and saw a female with wide eyes and a trembling voice. She appeared scared and had a shine on her skin as if she had been sweating. Behind her was a younger male child who also appeared scared as he was hiding behind her.Due to the severity of the call notes, I placed the male (Jonathan Franklin) into hand-cuffs. Officer Kareem escorted him to my Police vehicle where he ed him incident to arrest.I walked up to the residence with the female [VICTIM ] and the young male [WITNESS ]. [VICTIM ] advised she did not want Franklin to go to jail.I asked if I could come inside and they allowed me in. I asked if anyone else was in the residence. [VICTIM ] was having trouble gathering her words at first to answer. I then quickly cleared the residence to make sure no others were inside, nor injured. [VICTIM ] announced that no one else was inside as I finished the back rooms.I then met her back in the living room to speak about the incident. She was very upset and began crying. She started to explain the incident. From what I gathered, both [VICTIM ] and Franklin (Sr.) had been drinking this evening. I could smell it on their person after being around them.[VICTIM ] advised he was really drunk. They had been together for 12 years but recently broke up for a year. [VICTIM ] continued by saying she got a call from Franklin to pick him up and that he hurt himself at a skating rink. She advised that’s why his hand was injured. She then said that she was at her god sisters house and was informed that he was “here” and pointed at the interior of her residence.At this point her story was not making much sense. Her time line was spotty as she advised she got a call to pick him up but then he was at her residence. Her voice was very hoarse and raspy and she was swallowing a lot as I was speaking with her. I have met [VICTIM ] multiple times before this call and it did not sound like her normal voice that I have heard before.She then advised again he was really drunk and came inside going “ballistic”. She advised he did not hurt her but kept grabbing her hand and her arm. She advised she asked him multiple times to leave. She then said “he was not going to leave”.I then observed a clear hand print of blood around [VICTIM ]’s neck. It appeared as if there was a finger print sized patch of blood under right ear (near where the ear meets the jaw and neck area). It appeared like the blood went down the right side of her neck. I observed more blood under her chin (on her neck). The blood was dried and cracking with the creases of her skin on her neck. There was more blood on the left side of her neck, below her left ear (also near where the ear meets the jaw and neck area). The blood on the left side was rubbed into her skin more and appeared to be blending in with her skin. It was obvious it was blood and consistent with the other blood located on the rest of her neck. She also had blood on her right hand.[VICTIM ] reiterated she was not injured. She did not appear to be bleeding from anywhere. She advised the blood came from him. I asked her if I could speak to her child ([WITNESS ], who was sitting behind us in the living room hiding behind a pillow). She at first was going to let me speak with him but then stated “you do not have to”. [WITNESS ] shook his head no and refused to speak to me.I then explained to [VICTIM ] about the details of our call notes. I told her how the Police call indicated that he was “choking her” and that the blood on his hand is consistent with the blood on her neck. I was attempting to gather more detail on how that occurred. She then said that was because he was grabbing at there arm and her shirt. She then said it was because he was grabbing at her hair. All of her explanations still did not describe how the blood got all the way around her neck like a hand print.She then began wiping at the blood on her neck area. She then stated “I do not know” and “my head hurts”. She gave me the impression that she was having a hard time remembering what occurred. I asked her about the threats to kill her. She stated she did not hear that but he must have said that in the living room area.I asked a few more questions on why he was coming over to the house. She said she was not sure and could not remember and was not sure. She advised he grabbed her by the hair once more and was acting crazy. She advised the incident happened in the bedroom. When I asked about the bedroom, she advised that the incident happened in the living room. Another inconsistency to her story. When she corrected me it seemed she was trying to grasp her thoughts on what happened.I took photos of the blood on her hands and neck area. I checked her eyes and saw signs of “bloodshot” eyes. I asked her if she needed EMS and she refused.During the course of the investigation, she advised there were items thrown around the house. It appeared that a struggle may have taken place in the living room. I noticed a tall white floor fan in the middle of the floor that was broken. I photographed the damaged fan.I then read [VICTIM ] the DVA Lethality questions.I walked out to speak with Franklin. He was standing with Officer Kareem outside of my Patrol vehicle. Officer Kareem had ed him incident to arrest. Franklin requested all of his belongings stay with [VICTIM ]. I tried to speak with Franklin but he would not let me speak nor allow me to explain what was happening. He made multiple indications that he would talk, and as I would speak he would talk over me. I tried to read him Miranda multiple times but he would not allow me. Instead of entertaining his banter, I told him his current charges and sat him in my Police car.I then ed my shift supervisor on the evidence I had towards Aggravated Assault DVA (Strangulation). We collectively agreed the evidence was there to DVA Detectives. I notified DVA Detectives and spoke with Detective Hogan. She also agreed with my articulation of the strangulation. With that, the call notes for service stating that Franklin was “using his hands to kill her” and “choking mother”, the obvious fear from both [VICTIM ] and her son (caller), the obvious bloody hand print on [VICTIM ]’s neck that was consistent to the blood on Franklin’s right hand, the hoarse and raspy voice, the spotty memory and inconsistent statements about the incident, and Franklin’s criminal history of Domestic violence (not only to [VICTIM ] but another female victim as well), I came to the conclusion that [VICTIM ] was a victim of Aggravated Assault Strangulation (DVA). The action was likely to have happened during the course of their physical altercation.Due to my training, knowledge and experience in responding to many domestic related strangulation, symptoms of a spotty memory or memory loss or hoarse and raspy voice are typically present. Marks on the neck (especially bloody handprints from another) are indicators that a hand (or object) was used offensively and likely to or actually does cause serious bodily injury.Franklin has a lengthy history of being a suspect in physical domestic incidents and has been arrested for many violent crimes (domestic and non-domestic related).I then transported Franklin to Memorial Medical Center to be medically cleared before I took him to CCDC. He was asleep from the time we left the scene until we Once at the hospital, Franklin became very disorderly and began calling a “btch”, “pusy” and “fck niger”. He continuously asked what his charges were, and each time I explained them to him. I also informed him that he now was charged with Aggravated Assault DVA (Strangulation) as a result of my investigation. He grew very angry and was making threatening remarks and indications that he wanted to fight me.He then refused the medical personal to check his vitals and clear him for the jail. He refused all treatment, especially for the cut on his finger. The doctors wrote up a refusal document and cleared him from the hospital. I walked him back to my Police car where he was actively pulling his body weight away from me. He refused to get into my Police vehicle. I had to physically push him downward into the rear of my Police car. He finally sat down and fell asleep again.Once at the jail, I woke him up and walked him to the door. He was uncooperative and stated “I will beat your a*s” (adding another charge to his list of charges). He was pulling away and thrashing his upper body. He made statements of “once he is out of hand-cuffs” he would assault me.
