On September 8th, 2024
I responded to Kroger at 125 Main Street Market Place in Cartersville in reference to a dispute between Mr. James Parish and Mr. [REDACTED BY AGENCY].
I spoke with [REDACTED BY AGENCY] who stated that he was there to repossess Mr. Parish’s car. While in the process of loading the car up he did not realize that Mr. [WITNESS ] was inside the vehicle. Mr. [WITNESS ] got out of the vehicle and called Mr. Parish who was inside kroger and told him that his car was getting towed. Mr. Parish who is less came outside and confronted [REDACTED BY AGENCY] stated that Mr. Parish was being very aggressive towards him and ended up trying to fight with [REDACTED BY AGENCY] to not take the vehicle.
[REDACTED BY AGENCY] stated that during this Mr. Parish grabbed a knife with a black handle and cut the tow strap off of the vehicle worth $60.00 and then started to come towards him saying “Ill cut you”. When this happened [REDACTED BY AGENCY] stated that Mr. [WITNESS ] got Mr. Parish in a choke hold to keep Mr. Parish from advancing on [REDACTED BY AGENCY] who stated he was in fear for his life.
Ms. [WITNESS ] stated that she saw the tow truck back up to the vehicle and saw Mr. [WITNESS ] get out of it. She saw Mr. Parish come out and start fighting with [REDACTED BY AGENCY] and when Mr. Parish started going after [REDACTED BY AGENCY] she saw Mr. [WITNESS ] start pulling back on Mr. Parish and put him in a choke hold.
Ms. [WITNESS ] stated she saw the tow truck back up with Mr. [WITNESS ] still in the vehicle she stated that Mr Parish was never violent he just didn’t want [REDACTED BY AGENCY] to take his car. She stated that it was actually [REDACTED BY AGENCY] who started getting violent and that all Mr. Parish wanted was for [REDACTED BY AGENCY] not to take his car.
Mr. [WITNESS ] stated that [REDACTED BY AGENCY] pulled up to load the car and all Mr. Parish was doing was telling him he had things in the car and wanted to get his things. He said Mr. Parish didn’t have a knife and that [REDACTED BY AGENCY] brandished a gun which was later determined to be pepper spray. And that it was uncalled for.
Mr. [WITNESS ] stated that he was in the vehicle when [REDACTED BY AGENCY] started loading it up for repossession. He got out of the car and called Mr. Parish who came out and became irate with [REDACTED BY AGENCY]. Mr. [WITNESS ] stated that Mr. Parish did in fact grab the knife and cut the tow strap and that he started to advance towards [REDACTED BY AGENCY] stating his was going to cut him with the knife when Mr. [WITNESS ] stated he did put Mr. Parish in a choke hold to keep him from getting to [REDACTED BY AGENCY] with the knife.
After talking to witnesses’s, and locating the knife between the drivers seat and the door in Mr. Parish’s vehicle, Mr. Parish was placed under arrest for aggravated assault and criminal trespass damage to property. Both hands were cuffed behind the back and checked for fit. I escorted Mr. Parish to my marked patrol unit where I did another pat down on him. While doing this Mr. Parish stated that he had to use the restroom but that he couldn’t make it to the jail and urinated on himself in the parking lot. I then placed him in the backseat of my marked patrol unit and transported him to the Bartow County Detention Center without incident.
The knife was placed into evidence at the Cartersville Police Department. This incident was captured on my body worn camera and [REDACTED BY AGENCY] stated he was in fear for his life and wanted to press charges.
