On Friday, July 12, 2024
, at 2155 hours, I responded to [10 BLOCK] Townsley Drive, Cartersville in reference to a domestic dispute.
While en route to the call, I was advised by Bartow 911 that the caller had been cut by her husband and had fled in a white Nissan Titan pickup.
Upon arrival, I made with the Complainant/Victim, Ms. [VICTIM ]. Ms. [VICTIM ] stated she and her husband, Mr. Mainor Hernandez had been married for eight years but were going through a divorce. Ms. [VICTIM ] stated Mr. Hernandez had been drinking tonight and the two began to argue. Ms. [VICTIM ] stated during the argument Mr. Hernandez picked up a Playstation controller and threw it into the wall causing a hole in the living room area. Ms. [VICTIM ] stated that she was then struck in the face two times by Mr. Hernandez in the presence of her eight-year-old son. Ms. [VICTIM ] stated she then waked away and entered the kitchen with Mr. Hernandez following her. Once in the kitchen, Ms. [VICTIM ] stated that Mr. Hernandez picked up a bread knife and held it to her throat. Ms. [VICTIM ] stated Mr. Hernandez cut her with the knife then put the knife down and fled the in a white, Nissan Titan pickup being GA tag [REDACTED].
I observed a small laceration to the throat of Ms. [VICTIM ] approximately one-quarter inch in length. The wound was not deep and Ms. [VICTIM ] refused any medical service. I also observed redness and swelling near the right eye. A hole was noted in the wall which was consistent with the Playstation controller which was seen on the floor located the bread knife on the cutting board in the kitchen and collected it for evidence.
Ms. [VICTIM ] was advised of her rights as a victim and provided a case card.
A BOLO was issued for the suspect vehicle while other units attempted to locate Mr. Hernandez. Mr. Hernandez was not located.
The knife was entered into evidence at the Cartersville Police Department. A criminal history showed no prior arrests for family violence.
On Saturday, July 13, 2024
, at approximately 0150 hours, the above-mentioned vehicle was observed at [10 BLOCK] Townsley Dr. was made with Mr. Hernandez who was taken into custody without incident.
Mr. Hernandez was advised of his Miranda rights and agreed to speak with me. Mr. Hernandez was asked what had happened to his wife’s face and neck. Mr. Hernandez stated that was from poison ivy. When asked how her neck was cut, Mr. Hernandez continued to say poison ivy.
Mr. Hernandez was handcuffed behind his back. The cuffs were double locked and checked for fit. Mr. Hernandez was transported and released to the Bartow County Jail. The patrol vehicle was ed at the beginning of the shift prior to and after transport with no contraband found.
Warrants were issued for Mr. Hernandez for Aggravated Assault, Criminal Trespass and Cruelty to Children 3rd. The warrants were scanned and attached to the report.
