On September 5, 2024, I Officer F. Ruiz responded to the area of Airport Rd & Walnut Ave, in reference to a motor vehicle hit and run.
On arrival, I met with [WITNESS #1], a witness to the motor vehicle accident. [WITNESS #1] advise she was facing East on Walnut Ave, at the intersection of Walnut Ave & Airport Rd. She advised that as she sat waiting for the traffic light to change she observed a white pick up truck (Tx tag [REDACTED]) approach the intersection of Airport Rd & Walnut Ave, facing Morris St. [WITNESS #1] advised this pick up truck did not have any headlights and was hardly visible. She advised that as she observed the truck she observed an SUV (Ga tag [REDACTED]) approach the intersection and rear end the pick up truck (Tx tag [REDACTED]). [WITNESS #1] advised that she then relocated to the intersection of Airport Rd facing Morris St. [WITNESS #1] advised she approached the white pick up truck to check on the driver and observed a Hispanic male waving his arms up and down. [WITNESS #1] advise the driver did not want any help and did not want to make contact. [WITNESS #1] advised the white pick up truck drove off as soon as the traffic light turned green. [WITNESS #1] was able to get a partial tag and a description of the pick up truck.
The driver of the SUV ([REDACTED]) was identified as [VICTIM #1]. He advised he was unable to see the white pick up truck due to the vehicles brake lights not being lit. [VICTIM #1] advised he was unable to stop due to how close he was to the vehicle. [VICTIM #1] advised he did not observe the driver of the white pick up truck.
Shortly after, Officer Warren was able to make contact with the pick up truck at 2001 Morris St, based on the description given by [WITNESS #1]. The pick up truck was described as a Nissan Frontier with a Texas plate and rear end damage.
Officer Warren advised he had made contact with the registered owner of the vehicle ([REDACTED]). She stated she was in an accident and then drove off because she did not know what to do. I then informed Officer Warren that the witness stated it was a male driver. Officer Warren detained her as I relocate to 2001 Morris St.
On arrival, I met with [REDACTED] she advised she was no longer going to keep up the act and stated her cousin was driving the pick up truck. She informed us that he was living in the room behind the building. Officer Warren and I then made contact with Desiderio Rios Martinez. He was read miranda and placed in handcuffs. Officer Warren then searched him incident to arrest. When Martinez was asked what happened at the scene Martinez advised he was at the light when he was rear ended. He advised he was scared and left the scene because he was unlicensed.
Martinez was advised he was under arrest for driving while unlicensed and hit and run. Martinez was searched incident to arrest.
The patrol vehicle was visually searched prior to seat belting him in and prior to leaving the jail sally port.
My weapon was secured in the sally port lock box prior to entering the jail.
Once at the jail custody of him was transferred over to booking staff along with his belongings and documents. He had no known medical or security risks. He advised he was a citizen of Mexico. He wished to notify the consulate. The form was filled out and faxed to the appropriate office.
When at the jail Martinez was cited with the following:
