On 12/21/2024
I was dispatched to [300 block] Brantley Drive lot [REDACTED], in reference to a domestic dispute.
Upon arrival I made with [VICTIM ], who stated her boyfriend punched her in the back of her head multiple times after they had an argument.
[VICTIM ] stated, Mr Stewart was drinking alcohol and while she was in her bedroom folding clothes, Mr Stewart came in and accused her of saying “something” he then started punching her in the back of her head with both fists. [VICTIM ] stated she fell unto the bed. While she was on the bed Mr Stewart held her neck with both hands and “choked” her, while saying “I will kill you bi*ch” [VICTIM ] stated she could not breathe. While Mr Stewart was choking her, she started to fight back. [VICTIM ] got up and slammed her printer onto the floor, which caused it to break. He also caused damage to a section of the wall in the bedroom. I was shown the damaged printer (hp serial # [REDACTED]) I also observed a hole in the wall of the bedroom, (photos were taken with my body camera). [VICTIM ] stated Mr Stewart started to pack his belongings to leave the residence. As he was packing, he threw a sword out the front door, almost hitting [VICTIM ] who was standing outside. She stated the sword was inside its sheath. [VICTIM ] stated he placed his belongings in her vehicle and left the scene while she was on the phone with 911, she was able to give a description of the vehicle to central dispatch.
The vehicle a white Chrysler 200 tag [REDACTED] was intercepted by Riddick (120) and a traffic stop was initiated at the light between Ihop and the new car wash being built. Officer Riddick observed Mr Stewart was not wearing his seat belt. A GCIC/NCIC check of the vehicle revealed it had no insurance. Officer Riddick also smelled the odor of an alcoholic beverage emitting from the vehicle Sgt Lui (149) arrived on scene and also smelled the odor of an alcoholic beverage coming from the vehicle. Mr Stewart’s information along with the vehicle was ran through GCIC, and came back showing his license was suspended. Sgt Lui (149) read Mr Stewart his miranda rights and implied consent for persons 21 and over. Sgt Lui requested a breath sample from me Stewart, to which he agreed.
Officer Conley (134) arrived on scene and transported Mr Stewart to the Liberty County Jail where he was tested for alcohol with the intoxylizer 9000. He had a .108 BAC.
Mr Stewart, was cited for the above violations and charged with criminal trespass damage (fva) and aggravated assault (fva).
A pamphlet with a CRN was issued to [VICTIM ].
