On 08-31-2024 at 1221, Sergeant Brunson was dispatched to 1502 Cleveland Hwy. (Meander Shop) in reference to a welfare check on a female. Before Sergeant Brunson arrived on scene dispatch advised the female had followed a subject to a car and attempted to get into the car. The caller and her granddaughter were locked in the bathroom at the Meander Shop until it was safe to come out. Deputy Loftis responded to the call as well and was talking with the female (later identified as Cody Ensley) inside the Meander Shop when Sergeant Brunson arrived.
[WITNESS #1] and [REDACTED BY AGENCY] came outside and Sergeant Brunson spoke with them briefly. [REDACTED BY AGENCY] was visibly shaking and upset from [REDACTED BY AGENCY] encounter with Cody Ensley. [REDACTED BY AGENCY] stated Cody had been following [REDACTED BY AGENCY] around inside the store getting very close to [REDACTED BY AGENCY] and started touching [REDACTED BY AGENCY] arm. [REDACTED BY AGENCY] did not want to be touched and did not give Cody permission to touch [REDACTED BY AGENCY]. [REDACTED BY AGENCY] went outside to the car to get away from Cody who followed [REDACTED BY AGENCY] to the car and tried to get in the car. [WITNESS #1] had [REDACTED BY AGENCY] go back inside the store with her and they locked themselves in the bathroom.
Deputy Loftis was attempting to get Cody to walk outside the store. Once outside Cody was asked multiple times by Sergeant Brunson and Deputy Loftis to move from in front of the door before she would move. Deputy Loftis continued to speak with Cody while Sergeant Brinson continued to speak with others on the scene. [VICTIM #1] stated she asked Cody to leave the store numerous times and she would not. [VICTIM #1] advised Cody was not acting right and didn’t seem to understand. [WITNESS #1] confirmed that Cody had been asked to leave multiple times.
Sergeant Brunson spoke with [REDACTED BY AGENCY] again to confirm the details [REDACTED BY AGENCY] had stated. Sergeant Brunson asked if [REDACTED BY AGENCY] wanted to press charges. [REDACTED BY AGENCY] spoke with [WITNESS #1] before deciding to press charges on Cody Ensley.
Sergeant Brunson and Deputy Lofts had Cody stand and started to place her in handcuffs as Sergeant Brunson advised Cody she was under arrest. Cody began to physically struggle against the deputies. Sergeant Brunson advised Deputy Loftis to place her on the ground to attempt getting control of her. Cody continued to struggle and not comply with verbal commands of the deputies. After several minutes of struggling with Cody she was restrained with handcuffs behind her back. During the struggling both Sergeant Brunson’s and Deputy Lofts’ body worn cameras were knocked off. The handcuffs were double locked before placing Cody in the rear seat of Deputy Loftis’ patrol vehicle.
Deputy Vazquez arrived on scene. Deputy Lofts transported Cody to the Whitfield County Jail. Deputy Vazquez collected the personal information of [WITNESS #1] and [REDACTED BY AGENCY] while Sergeant Brunson followed up with [VICTIM #1].
[VICTIM #1] stated Cody had come in the store and was throwing items into the floor. Cody began following customers around and cursing at them. Sergeant Brunson confirmed that [VICTIM #1] had asked Cody to leave and she had not left the store. Sergeant Brunson provided the case number to [VICTIM #1] and [REDACTED BY AGENCY].
Sergeant Brunson relocated to the Whitfield County Jail to write the charges on Cody Ensley. It was at the jail that Cody was identified as she had no ID on her. At that time, it was discovered that Cody had a warrant through Whitfield County for Probation Violation. Sergeant Brunson served the Probation Warrant #24-60538 on Cody. The original charge she is on Probation for is Poss. of Alprazolam. Cody violated the terms of her Probation by being arrested on 07-11-2024 for the offenses of Disorderly Conduct and Willful Obstruction of Officers.
For the incident at 1502 Cleveland Hwy Sergeant Brunson charged Cody Ensley on Warrantless Arrest #69169 with the following.
16-7-21 Criminal Trespass of Property when she did not leave the property when asked to do so by the store owner [VICTIM #1].
16-11-39 Disorderly Conduct when she disrupted the business by following customers through the store cursing at them.
16-5-23 Simple Battery for the unwanted touching of [REDACTED BY AGENCY].
16-10-24 Willful Obstruction of Officers when she struggled and fought against Sergeant Brunson and Deputy Loftis when they attempted to take her into custody and advised her she was under arrest.
