Driver Statements:
Driver of Vehicle : [VICTIM ] (2023 Toyota Camry, Silver, Georgia Plate # [REDACTED])
[VICTIM ] stated he was traveling on Hwy 515 northbound, at approximately 65 mph. After crossing over Hwy 108, [VICTIM ] noticed vehicle 1 emerge directly behind him at a high rate of speed. Vehicle 1 slowed its speed enough to avoid a direct collision but continued following [VICTIM ]’s vehicle extremely close (OCGA 40-6-49, following too closely). [VICTIM ] said the driver of vehicle 1 flashed his bright lights at him (OCGA 40-6-397, aggressive driving). [VICTIM ] said he could not move over because there were other vehicles in his immediate area, it was unsafe for him to do so. [VICTIM ] said vehicle 1 suddenly jerked into the right-hand lane, accelerating aggressively, attempting to pass. When the driver of vehicle 1 did this, vehicle 1 collided with the rear of [VICTIM ]’s Camry, causing significant damage (OCGA 40-6-390, reckless driving). [VICTIM ] said vehicle 1 did not stop after the collision, instead continued driving northbound into Jasper (OCGA 40-6-273, duty to report an accident). [VICTIM ] changed into the right-hand lane and followed vehicle 1, ultimately stopping approximately 150 feet on Camp Rd and alerting law enforcement. (Photos of damage uploaded at Axon evidence)
Driver of Vehicle : Patrick McDonald (2013 Dodge Ram 1500, Gray, Georgia Plate # [REDACTED])
After apprehending Patrick the following morning during a traffic stop, Patrick stated the driver of vehicle 2 “brake-checked” him, causing the accident. He said this could have been due to road rage. When asked why Patrick didn’t immediately alert law enforcement (as per OCGA 40-6-273), Patrick stated he wanted to go and sleep. Determination:
Based on the statements, visible damage, and all available evidence, Patrick (Driver of vehicle 1) was determined to be at fault for the collision. Both vehicles sustained moderate and functional damage. [VICTIM ] drove vehicle 2 away from the scene after reporting the initial collision. Vehicle 1 was inventoried and towed by A and T Towing after taking Patrick into custody, the following morning. No injuries were observed or reported.
