On Friday, 8/2/24, I responded to the report of an individual causing a verbal disturbance. Upon arrival, people in the area were pointing at a male individual, identified as JUSTIN HERBERT. I was informed he was yelling and using profanity towards people near him and walking by.
As I approached Herbert, he was yelling and acting disorderly. I told him he needed to calm down, and could not act as he was. Herbert agreed with me and said he was just angry and would stop.
Herbert provided me with his I.D. While checking his information, he sat on the curb in front of the patrol vehicle. While doing so, Herbert yelled out profanity to someone across the street. I addressed his behavior again, stating it was his last warning.
As I finished attaching his information to the call notes, he yelled profanity at others again. This time there was a family with young children near him. At that time I placed Herbert under arrest for disorderly conduct.
Herbert and his belongings were ed incident to arrest. His handcuffs were checked for proper fit and were double-locked. Herbert was transported and booked into CCDC without incident. Herbert’s belongings were logged into the Savannah Police Property Room for safekeeping.
CHARGE
16-11-39 “Disorderly Conduct” -Herbert continued to yell profanity breaching the peace in a public area. Herbert continued the behavior after being told and agreeing to stop. His behavior was also conducted in the presence of young children.
