GIORGIONE with Gordon County Sheriff’s Office Uniform Patrol Division responded to the Taco Bell located at 2234 Hwy 41 N Calhoun, Gordon County, Ga 30701 in reference to a sexual assault report.Upon arrival, Deputy GIORGIONE met with complainant Juvenile [VICTIM ] and her mother [REDACTED]. Juvenile [VICTIM ] stated on this date, at approximately 2130 hours, while she was at work at the drive through window attempting to complete an order, her co worker, JASON CABEZAS, had touched her on her breasts and placed a sticker on her. Juvenile [VICTIM ] stated when JASON touched her breasts, he had intentionally rubbed down her breast after placing the sticker. Juvenile [VICTIM ] stated that JASON would not leave her alone through out the night. Juvenile [VICTIM ] stated multiple co worker’s witnessed the incident. Juvenile [VICTIM ] stated she would complete a written statement.Deputy GIORGIONE then spoke with [WITNESS ]. [WITNESS ] stated he only observed what happened from behind Juvenile [VICTIM ]. [WITNESS ] stated he did observe JASON move his hand toward the breast area of Juvenile [VICTIM ].Deputy GIORGIONE then spoke with [WITNESS ]. [WITNESS ] stated JASON had walking up to Juvenile [VICTIM ] attempting to speak with her throughout the night. [WITNESS ] stated as Juvenile [VICTIM ] was working in the drive through window, he observed JASON place his hand on Juvenile [VICTIM ]’s breast and rub down while placing a sticker on her. [WITNESS ] stated he would complete a witness statement.The manager of Taco Bell [WITNESS ] stated JASON was sent early after the incident had occurred. Deputy GIORGIONE was able to obtain JASON’s address and driver’s license. Deputy GIORGIONE provided Juvenile [VICTIM ]’s mother, [REDACTED], with a case number along with resources to assist for this incident.Deputy GIORGIONE then went to JASON’s residence located at [200 BLOCK] Soldier’s Pathway. Deputy GIORGIONE asked JASON what had happened today in which he stated nothing and that he was early from work. When asked why he was sent early he stated he did not know why. Deputy GIORGIONE asked if JASON had touched anyone today in which he stated he did not.At this time, Deputy GIORGIONE placed JASON under arrest. JASON was placed in handcuff’s behind the back, checked for proper fit, and double locked. Deputy GIORGIONE placed JASON in the rear seat of his patrol car. Deputy GIORGIONE transported JASON to the Gordon County Jail. Deputy GIORGIONE obtained a state warrant for JASON CABEZAS for sexual battery.All written statements were placed in the case file.
