Discretion is advised.]On 11/18/2024at approximately 1848 hours I was dispatched to a motor vehicle crash on Eatonton Rd in front of Walmart. I arrived on scene immediately after being dispatched and observed a gray SUV which had apparently struck a white utility truck from the rear. I learned from parties on scene that the driver of the gray SUV was a hispanic male who had fled the scene on foot immediately after the crash. The subject was said to be wearing a lime green undershirt with a jacket over top. A brief check of the vehicle revealed a corona beer bottle in the driver floor board.MCSO Deputy Ptak 49 located a subject matching the description near the area of Bank of Madison on Eatonton Rd. The subject was confirmed to be the driver and was detained and transported back to the crash scene. The subject was identified as Juan Garcia-Gregario. Garcia’s passport was also located inside the vehicle.Upon his arrival, I conducted a field interview about what had happened. Garcia stated that the vehicle in front of him stopped unexpectedly and that he could not stop his vehicle in time. While speaking with Garcia, I did notice the odor of alcoholic beverage coming from his breath. Garcia had glassy, bloodshot eyes and a slow speech pattern. I asked Garcia how much he had to drink, and he stated that he consumed approximately six beers at 4:30 this evening. I asked Garcia to submit to Standardized Field Sobriety Testing (HGN only) and he stated that he would. I attempted to perform this test but Garcia appeared too intoxicated to properly follow the instructions. Despite this, I did observe the lack of smooth pursuit in each of Garcia’s eyes and also distinct and sustained nystagmus in Garcia’s left eye at maximum deviation.The remaining portions of SFST were not conducted due to Garcia’s proven inclination to flee. I asked Garcia to submit to a portable breath test, to which he agreed. The PBT confirmed a positive reading for alcohol at .112.I read GA implied consent and asked Garcia for a blood test, which he refused. Garcia was transported to MCSO DC and released to detention staff.[End of Narrative].
