, I, Deputy Kemp, was dispatched to [400 BLOCK] Arrowhead Dr in reference to a domestic dispute. I arrived on scene at approximately 2:25 PM and made with the victim, [VICTIM ], and the complainant, [WITNESS ].
[VICTIM ] told me that she is a part of the HOA in the neighborhood and was attempting to check the water meter on Sean Yap Maxwell’s property. [VICTIM ] stated the hole the water meter was in was filled up with water and could not be checked. So [VICTIM ] used a bucket to scoop out the water from the hole to access the water meter. While doing so, Sean approached her from behind, pushed [VICTIM ], and ripped the bucket out of [VICTIM ]’s hands, which caused her to fall into the hole.
[WITNESS ] showed deputies a video she had that showed Sean ripping the bucket out of [VICTIM ]’s hands, and it showed [VICTIM ] falling into the hole. After the fall, you can hear Sean yelling, and I told her not to do that. [VICTIM ] had slight irritation on her skin, her right arm, and her left leg from falling. [VICTIM ]’s pants were also wet and muddy about halfway up her shin.
I went over to speak with Sean, and Sean stated that [VICTIM ] was a part of the HOA and was attempting to check his water meter. Sean then stated he had pulled the bucket from [VICTIM ]’s hands, and she had fallen into the hole. Sean then stated the HOA had no right to be on his property and check his water meter.
[WITNESS ] showed me Deputy Tymkew and their HOA paperwork, which states they control the water in the neighborhood and have the right to check the water meters on the property under the HOA.
Sean had cameras on his house that would have shown the incident that occurred, but he did not want to allow deputies to come inside his house to review the camera footage. With the information provided, I placed Sean under arrest for simple battery. I placed Sean into handcuffs, checked for proper fitment, and double-locked them. I then walked Sean to the front of my patrol car and ed Sean incident to arrest. Sean had a bag in his pocket with visible cash and keys and requested his neighbor to place his items inside his house. I handed the items to his neighbor, placed Sean in my patrol car’s passenger-side back seat, and buckled him in.
I then transported Sean to the Paulding County Jail, and he was turned over to jail staff to go through the booking process without incident or injury.
Warrants were secured for Sean.
