On August 17, 2024
, at approximately 2239 hours, I, Ofc. Spruell, responded to [100 BLOCK] Brock Street (Cross Creek Apartments) in reference to multiple shots fired near the “[REDACTED]” building. Dispatch advised that there were multiple 911 callers who had heard “7-8” shots.
Upon arrival, I parked my marked patrol vehicle near the entrance and approached the complex on foot along with other officers.
As I approached the area of building [REDACTED], I observed a black Hyundai Sonata (GA TAG: [REDACTED]), attempting to leave the apartment complex. I observed the vehicle to have two black females occupying it. The females were later identified as [VICTIM ] and [REDACTED]. At the same moment that I observed the vehicle, I also observed a taller, heavy-set black male, who was shirtless, walking toward the vehicle in the parking lot. I kept eyes on the individual (later identified as Kenneth Moore) and slowly approached him while Ofc. Christensen made with the vehicle. Moore seemed to be intoxicated based on his slow and exaggerated movements. Moore appeared to have just been involved in some type of dispute. He seemed to be sweaty, pale, and out of breath. At this time, based on what I had observed, I was confident that the three individuals who I was out with were the individuals who were involved in the dispute that multiple people had called 911 about.
Based on the fact that [VICTIM ] and [REDACTED] were attempting to leave the scene, I suspected that Moore either had been or was still in possession of the gun in question that had just been fired several times. I approached Moore with my department-issued handgun at a low ready, telling him to keep his hands where I could see them and asking him where the gun was. Once I determined that Moore was being compliant and I had other officers within my immediate vicinity who had lethal coverage, I holstered my weapon and got even closer to Moore. Moore obeyed my commands by keeping his hand raised in the air. Moore quickly told me that he was the individual who had the gun. Moore then told me that the gun was not on him but that it was back inside the apartment. At this time, I informed Moore that he was being detained. I placed Moore into a pair of double -locked handcuffs, which were checked for proper tightness and fitment, with his hands behind his back. Moore consented to a of his person, and I conducted one, finding nothing of interest.
I began questioning Moore further, attempting to obtain as much imminently relevant information as I could to determine if there was still an active threat. Moore reiterated that the gun was inside of the apartment on the couch and that there was no one currently in the apartment whatsoever.
Moore started to tell me about what happened, stating that he and [VICTIM ] had gotten into an “altercation” and “being drunk”. Moore was unable to tell me what the actual argument was about. Moore said that at one point during the argument, he asked [VICTIM ] to leave. Moore stated that [VICTIM ] was in the process of leaving but that she had his cup and that he had been attempting to get the cup back from her before she left. Moore told me that he grabbed the cup from [VICTIM ], which started some sort of struggle. Moore said that after the struggle, he pulled his gun out. Moore admitted to me that he had his gun on his person during the entire altercation.
Moore then admitted to firing his gun off during the dispute, telling me that he did so while [VICTIM ] was inside of her parked car. After hearing Moore’s admission of firing the gun off, I read him his Miranda rights, and he agreed to continue speaking with me. Moore said that while he was firing the handgun, he was standing directly next to the driver’s side of the vehicle, shooting toward the ground, which was in the direction of building [REDACTED] and apartments [REDACTED], [REDACTED], [REDACTED], and [REDACTED]. Moore told me that [VICTIM ]’s vehicle was parked in a parking stall directly in front of apartments [REDACTED] and [REDACTED] while he was firing the weapon.
At this time, I placed Moore in my patrol vehicle and continued speaking with him. Moore told me that he had fired the gun off because he wanted [VICTIM ] to leave. Moore also admitted to consuming alcohol. Throughout the entirety of my conversation with Moore, I observed his eyes to be bloodshot, watery, and glassy. I also smelled the strong odor of an alcoholic beverage emitting from Moore’s mouth.
Moore told me that [VICTIM ]’s passenger ([REDACTED]) had remained in the vehicle the entire time that she was there.
As I was questioning Moore, I noticed several shell casings on the ground in the parking lot directly in front of apartment [REDACTED].
After other officers conducted a safety sweep of Moore’s apartment ([REDACTED]), I approached to observe the scene. I observed two bullet holes on the building’s outer wall, approximately four to five feet above the ground, in between apartments [REDACTED] and [REDACTED] (see photos).
Inside of the apartment, I observed Moore’s Taurus “G3C” handgun on the living room couch where he told me it would be. I photographed the weapon before moving it and then made it clear and safe while wearing gloves. While doing so I observed the handgun to have a live round chambered as well as its twelve-round magazine to have two rounds remaining. As I continued to observe the apartment, I observed a bullet hole in the ceiling (see photos). When questioning Moore about the bullet hole in the ceiling, he told me that this was the result of a misfire that had occurred multiple months prior when he first bought the gun. I did not locate any shell casings within the apartment. It was determined that none of the projectiles that struck the building made through any of the walls or into any of the apartments. I also noticed multiple striation marks in the grass in front of apartment [REDACTED] that verified Moore’s story of shooting toward apartment [REDACTED] from the parking lot.
While still on scene, K9 Ofc. Puckett and Ofc. Christensen informed me that they had interviewed both [VICTIM ] and [REDACTED], who both refused to provide any relevant information regarding the incident.
Cpl. Maxwell and Cpl. Moreau interviewed multiple witnesses who lived in the apartment complex, and they informed me of their findings (see supplementals for further). Multiple witnesses heard a female screaming and banging on a door before hearing multiple gunshots ring out in the area in front of building [REDACTED].
Before leaving, I collected Moore’s black and tan Taurus “G3C” 9mm handgun (SN: ACL541776), along with its 12-round magazine that contained three rounds, as 295A.
Cpl. Moreau also collected all seven 9mm shell casings as 295B.
While on the scene, I determined that the 9mm shell casings matched the live 9mm rounds that were located in Moore’s Taurus handgun. Both were stamped “9mm Luger Hornady”.
Based on the physical and testimonial evidence, including Moore’s admissions, I placed him under arrest. Moore was transported to the Carroll County Sheriff’s Office and turned over to booking without incident.
Kenneth Moore was charged with the following:
Aggravated Assault – O.C.G.A. 16-5-21
Moore committed the above when he knowingly and willingly fired multiple 9mm rounds into the ground beside building [REDACTED] and directly into building [REDACTED] in the direction of multiple individuals, including his ex-girlfriend and the residents of apartments [REDACTED], [REDACTED], and [REDACTED]. Moore’s intentional and offensive actions directly put multiple individuals at an imminent risk of receiving serious bodily injury or even death.
Criminal Damage to Property (2nd Degree) – O.C.G.A. 16-7-23
Moore committed the above when he fired multiple 9mm rounds into the siding of apartment building [REDACTED], causing significant damage. I estimated the damage to be greater than $500 based on my experience.
Public Drunkenness – O.C.G.A. 16-11-41
Moore committed the above when he drunkenly fought his ex-girlfriend ([VICTIM ]) over a water bottle in the parking lot, in the public view of the entire apartment complex. Moore manifested his intoxication while doing so in a boisterous manner.
Moore admitted to all of the above actions.
