Discretion is advised.]On Friday, January 16, 2025 at approximately 1649 hours I was dispatched to 4000 Hwy 20 (Culver’s) in reference to an assault.I made contact with the complainant, [VICTIM #1], who advised a female became irate in the restaurant due to her food taking too long. [VICTIM #1] advised the female, identified as Ms. Cynthia Nunn,was demanding her food due to being late. [VICTIM #1] stated she had the bag of food in her hand when Ms.Nunn walked around the checkout counter, entered into employee work space, and grabbed [VICTIM #1]’s arm and the bag of food. [VICTIM #1] advised the female took the bag and exited the building quickly and left in a silver in color Subaru Outback (GA tag: [REDACTED]).I observed [VICTIM #1]’s right forearm and observed a red mark with swelling beginning to form. I photographed the visible injury on my department issued body worn camera. [VICTIM #1] was able to show me video footage of the incident on scene. I observed Ms. Nunn speaking to employees on the oppositeside of the checkout counter. [VICTIM #1] is observed in the employee workspace placing food items into a bag also speaking. Ms. Nunn is then observed walking around the counter, walking up to [VICTIM #1], and snatching the bag of food out of [VICTIM #1]’s hands. I utilized the zoom feature on the video footage and observed Ms. Nunn’s left hand make contact with [VICTIM #1]’s right forearm, corresponding with the visible injury observed. [VICTIM #1] was provided a Polaris citizen upload link to upload the video footage. She completed a business records verification form, which was placed into evidence at Cartersville Police department.I utilized GCIC/NCIC and checked the tag number provided by [VICTIM #1]. Ms. Nunn was one of the registered owners of the vehicle. I obtained a drivers license photo and compared it to the female on the video to identify the suspect. I utilized the phone number attached to Ms. Nunn’s drivers license and made contact with her via cellphone. I advised Ms. Nunn I was investigating an incident that occurred at Culver’s and advised her I needed to meet with her at Cartersville Police Department.[VICTIM #1] advised she wished to press charges. [VICTIM #1] was provided a case number and advised hercrime victim rights. [VICTIM #1] also wished to have Ms. Nunn criminally trespassed from the business.I met with Ms. Nunn at 195 Cassville Rd, Cartersville Police Department. I advised Ms. Nunn the business wished to have her criminally trespassed and advised her she is not to return to property under any circumstance. Ms. Nunn signed the copies of the criminal trespass warning and was provided a copy.Ms. Nunn was then placed in handcuffs behind her back, double locked, and checked for proper fit. Ms. Nunn was searched incident to arrest and yielded negative for any weapons or contraband. I read Ms. Nunn Miranda Rights, and Ms. Nunn advised she agreed to speak with officers.Ms. Nunn advised she and her husband went to Culver’s to grab a quick dinner before heading to her grandson’s game. Ms. Nunn stated that they had been waiting a long time and that one of the staff offered to give her the food to go. Ms. Nunn stated they needed to leave and that she saw her bag of food on the counter. She stated she asked for food and that the female ([VICTIM #1]) stated not all of the food was inside and that she couldn’t give her the bag yet. She advised [VICTIM #1] she didn’t care that not all of the food was there and that they needed to leave. Ms. Nunn stated they were not giving her the food so she walked around the counter, grabbed the bag of food, and left.Ms. Nunn was placed into the rear of my marked patrol vehicle that was searched before and after each transport. Ms. Nunn was transported to Bartow County Jail, 104 Zena Dr, where she was turned over to jail staff without incident.I obtained a warrant for Battery (M) (CE0178541).
