On July 27, 2024
I, Dep. C. Lewis responded to [4000 BLOCK] Elizabeth Court in reference to a domestic dispute between a husband and wife over a vehicle. Upon arrival I met with Mrs. Napier while Lt. Kosmoski spoke with Mr. [REDACTED].
Mrs. Napier stated that she came from Atlanta in order to retrieve her vehicle. She stated that her husband had the vehicle and that she wanted it. Mrs. Napier had a two truck on scene to remove the vehicle. Mrs. Napier stated that while she was waiting for Law Enforcement to arrive the vehicle had left the residence. She stated that she followed the vehicle as it sped through the neihborhood recklessly just to return back . Thats when she noticed that her daughter was driving the vehicle and not her husband. It was at that time Mrs. Napier approached the vehicle in order to take possession. It was at this time Mrs. Napier stated that Mr. [REDACTED] hit her several time in the face. Mrs. Napier then stated that she waited for Law Enofrcement to arrive.
Mr. [REDACTED] stated that his wife Mrs. Napier had caught a flight on July 26, 2024
in order to come get the vehicle that she allowed him to have. He stated that Mrs. Napier had showed up to his job earlier that morning to get the vehicle where Law Enforcement told both parties it was a civil issue and would have to be delt with in the courts. He stated that Mrs. Napier then showed up to the house he was staying at with his mother trying to take the car. Mr. [REDACTED] stated that no physical altercation took place besides him pushing his daughter into the house to avoid a bigger altercation when she came back in the vehicle.
I then began to speak with both parties. As im trying to explain that this was infact a civil issue Mrs. Napier coninued yelling and using profanity causing a disturbance in the neighborhood. Mrs. Napier was advised several times that she needed to stop. Mrs. Napier stated that we were being one sided during this altercation and that we have not even stated anything about Mr. [REDACTED] assaulting her. I advised Mrs. Napier that there was no evidence of the assault only her statement. At that time she advised me that her daughter had recorded the events and the assault would be on her phone.
I was then able to view both videos on Mrs. Napiers phone. It showed Mrs. Napier approaching the vehicle as her daught returned . Mrs. Napier was screaming and yelling calling her daughter a “bith and he.” Mr. [REDACTED] did get in between his wife and daughter but not assault occured. Mr. [REDACTED] guided his daughter into the house.
I then proceeded back to speak with Mrs. Napier and advised her that the video showed no evidence of a physical assault. Mrs. Napier stated that she wanted her husband arrest that he was already on probation. I advised Mrs. Napier that due to the alleged altercatoin and there being no evidence I would have to charge both parties with Disorderly Conduct. Mrs. Napier stated that she would bond out but that her husband wouldn’t get out due to him being on probation. Mrs. Napier stated that she still wanted charges pressed.
I then placed Mrs. Napier into custody and secured her in my vehilce. After that I placed Mr. [REDACTED] into custody and secured him in Lt. Kosmoskis vehicle.
We then began to transport both parties ti the LEC.
While enroute Mrs. Napier continued to stated that she cant breathe ad she wanted me to pull over and call her an ambulance. I notiied Lt. Kosmoski and I stopped at the 478 Liquidate on Columbus Rd.
While waiting for the ambulance to arrive Mrs. Napier made the statement as I was completeing her booking sheet that I should add that she lied about Mr. [REDACTED] assaulting her. She further stated that she only said that to get Mr. [REDACTED] arrested.
Mrs. Napier was cleared by EMS.
While enroute to the LEC with mrs. Napier I advised Lt. Kosmoski of the new information and that charges would not be pressed against Mr. [REDACTED].
Mrs. Napier stated while on the way to the jail she wanted to give a new statement of events. She began by stating that her and her children got a flight from Texas to Atlanta on July 26, 2024
. She stated that when she arrived she did goto her husbands job and try and get the vehicle. While there the local law enforcement agency told her that the issue was civil and that Mrs. Napier needed to goto court and have paperwork filed. Mrs. Napier stated that then she went to Atlanta Police Department where she was advised the same thing. Mrs. Napier then decided to come to Macon and take the vehicle despite what several officers advised her.
Mrs. Napier was booked into the Bibb County LEC for Disorderly Conduct and False report of a Crime. I then gave Mr. [REDACTED] a ride from the LEC back to his residence.
